unacceptable and unconstitutional bill approved by the Government at Work
"It was an ugly page written for Italian workers": thus defines the Group Leader of the Democratic Party in the Senate Anna Finocchiaro approval of the bill on the work at its meeting on March 3 by the center-right majority. A bill providing for a series of operations on relations between employers and work, including the invention of an "arbitration fairness" with which may be distorted contractual and legal rules, including hours of work may be, safety, salaries, etc., and the circumvention of Article. 18 of the Workers' Charter on the protection against dismissal without just cause.
"Arbitration in equity. ... Introduces the principle that we proceed without compliance with the laws, "says former Minister of Labour, the Honourable Professor PD. Tiziano Treu, adding that it may "derogate from national collective agreements, even without certification." Finally
Senator prof. Pietro Ichino, who objected to the bill so articulate in his speech to the Senate, said, inter alia, "the rules like this that you are launching will not be used by serious entrepreneurs (who are not looking for loopholes to circumvent the rights of their employees). "
The position of the PD is unclear. That bill is unacceptable and is suspected of being unconstitutional because:
a) surreptitiously introduces a direct individual bargaining between worker and the employer, not covered by our regulations, but with a choice definitely suffered from the first moment of greatest weakness: the assumption,
b) "Arbitration Fairness" introduces the possibility of exceptions to the general contracting and business and to circumvent state laws relating to employment,
c) is now a law firm disruptive referring to a subsequent agreement between the two sides for the insertion of the posts approved for the contract "arbitration" and then relegated to the social partners a subordinate role. A further attack on the system of social democracy.
has written a new page against the ugly legal certainty, to the detriment of the weaker again. The Democratic Party does not accept it and will use all means to prevent its implementation, calling the confederal unions to find a unified position to prevent a serious distortion of their own role and urging the employers' associations to defend the transparency and regularity of the competition, which could be distorted to the detriment of serious entrepreneurs that aim at contract certainty, quality of work and production.
